A woman who turned up at a friend’s home late at night dressed in her pyjamas claimed she had just been raped, a jury heard yesterday.
The friend’s daughter told the High Court in Livingston that her mum was out.
She described their visitor as “delirious” and said she did not seem to be aware of her surroundings because she was in such a state of shock.
The woman told jurors: “She was crying, her whole body was trembling and she was saying she didn’t feel right.
“She was looking for mum. She was wearing pyjamas with a jacket and had a bag of clothes with her.
“She had a drink in her but she wasn’t intoxicated. She knew what she was talking about.
“She knew what she was saying and she definitely knew what had happened to her.”
The alleged victim – a 55-year-old woman who cannot be identified for legal reasons – has already given evidence to the court.
Russian national Sergei Serjakov denies raping the woman to her severe injury after locking her inside his flat on Dens Road, Dundee, on October 2 last year.
He also denies sexually assaulting the 25-year-old witness in a Dundee pub between May 1 and September 30 2017 by repeatedly rubbing her thigh with his hand.
The witness – who cannot be named for legal reasons – said the pub incident had lasted for several seconds until she pushed his hand away.
She said she only reported the earlier incident to police after hearing the 55-year-old widow’s allegation that Serjakov had attacked and raped her.
The 25-year-old told police in a statement a few hours after the woman’s visit: “I just found her behaviour unusual. She said she felt like her drinks had been ‘spiked’ but didn’t know when.
“She said she was sitting on the couch and he sat beside her and she felt he was invading her space.
“She said he then attacked her.
“Throughout this, before and during, he was throwing her about and was really rough with her,” she added.
Under cross examination, the witness accepted she had told police the alleged attack happened in the living room, contradicting the alleged victim’s account it had continued in the bedroom.
Serjakov, 52, denies both the rape and sexual assault charges and has lodged a special defence claiming that any sexual intercourse was consensual.
