A Fife man who sexually assaulted a woman as she slept on his sofa has been jailed for 18 months.
Calum King, 26, of Camdean Crescent, Rosyth, admitted that he sexually assaulted the woman while she was asleep at his home by touching her intimately on October 18 2014.
Depute fiscal Claire Bremner previously told Dunfermline Sheriff Court that over a two-day period, King, the victim and another man had been “in and out of each other’s company” socialising at various places.
On the day of the offence, King returned home at 5am and he was joined by the male friend at 8am.
They were then joined by the female at around 11am and they all consumed alcohol throughout the day.
By around 6pm all three had fallen asleep.
The victim was asleep on a sofa in the living room when she was awakened by “the sensation of someone touching her” said the depute.
She became aware King’s hand was inside her underwear.
“It appeared that when he realised she was awake he got up and left the room,” added Ms Bremner.
The woman told the other man what had happened and then left to go to the home of a female friend.
She told her and another man about what had happened.
They later confronted King but he neither confirmed nor denied he had done it.
When King appeared for sentencing, defence solicitor Chris Sneddon said: “He doesn’t minimise the seriousness of the offence”, adding that the prospect of prison “terrifies him”.
Mr Sneddon went on: “He appreciates he made a terrible mistake.”
The solicitor had previously told the court that his client had met the woman a few times through friends.
They had not got on particularly well at first but spent time with each other on these days and he “misinterpreted things”.
Mr Sneddon said his client was “extremely sorry” for his actions and was “aware of the consequences”.
Sheriff Craig McSherry: “This is a sexual assault by touching a woman when she was in your home fast asleep. You came downstairs so there was some element of pre-planning.
“I appreciate that all parties were drunk. However, you only ceased when she awakened.”
The sheriff jailed King for 18 months.
