A thug who violently attacked guards in the cells at a court building because they wouldn’t let him sit in a cell with his mates has been jailed for 14 months.
Brian Kinloch flipped because he was placed in a single cell at Dunfermline Sheriff Court – normally reserved for sex offenders or “grasses”.
He worried he would be labelled as such when he was returned to Edinburgh’s Saughton jail and begged to be put in a communal cell with pals he had been brought to court with in a G4S prisoner transport van.
Kinloch sparked a “melee” when he was allowed out of his cell to use the toilet before battering guard Charles Wilson.
Fiscal depute Beverly Adam told Kirkcaldy Sheriff Court: “He wasn’t particularly happy because he wanted to be put in a cell with other prisoners he knew.
“He became abusive to G4S staff in the cell block.
“He was allowed out to the toilet and began to gesticulate at Mr Wilson and attempted to goad him in to a fight.
“When he came out of the toilet he became verbally abusive and then physical.
“There was a struggle between him and a female officer and Mr Wilson attempted to take hold of the accused.
“He lashed out at Mr Wilson, repeatedly punching him on the head.
“The struggle was heard by police officers who were upstairs in one of the courtrooms and they came to assist.
“Mr Wilson and the female officer went to hospital.
“Mr Wilson had a laceration to his left eye and was signed off work for a period.”
Kinloch, 28, a prisoner at HMP Perth, pleaded guilty on indictment to charges of behaving in a threatening or abusive manner and assault to injury.
Sheriff Grant McCulloch said: “You have given a reason for your conduct which I understand, but I do not accept it as an excuse for the way you kicked off.
“You have a significant record with previous convictions for assault to injury and assault to severe injury.”
