A milkman who was injured when he fell making a delivery to the Scottish National Portrait Gallery has won his battle for compensation.
Andrew Wright has won a payout from the National Galleries of Scotland after falling when his normal route was changed because of security concerns at the gallery.
Sheriff Principal Mhairi Stephen QC ordered the gallery operators to pay £1,875 in a Sheriff Appeal Court ruling which said they were to blame for the accident.
Mr Wright, who works for Graham’s Family Dairy, had regularly delivered milk to the Edinburgh gallery prior to the accident on November 18 2016.
However, his route into the café to deliver milk to the fridge was changed the day before after a security review of the premises had been carried out.
The sheriff principal said in her written judgement: “He had delivered to the gallery many times.
“Usually, he made his delivery of milk via the rear fire exit to the gallery with the assistance of the defender’s staff who allowed him access to the rear corridor where the fridge was located and into which he would unload the milk.
“He used this method of delivery until November 18 2016 at which point he was required by the gallery to make his deliveries via the main front entrance to the gallery on Queen Street.”
Mr Wright’s original claim was for £2,500, but he was awarded a reduced amount.
