Glasgow trio fined for Montrose street ‘melee’

A trio of Glasgow contractors working at a Mearns school got into a “melee” after the bell rang on their job, a court heard.

Stephen Clarke and brothers John and Gary Power brawled with a group of men across three streets in Montrose on July 12.

Forfar Sheriff Court heard a nightclub dispute spilled out on to the street after the men finished work at the replacement Mearns Academy in Laurencekirk.

Depute fiscal Hannah Kennedy said the complainer and two friends involved in the assault were also from out of town.

She added: “They had been on a training course. At about 5.30pm on July 11 they went out on the town.

“About 2am they left Busby’s nightclub and were making their way back to accommodation when there appears to have been an altercation with all three accused.”

The initial conflict had resolved but the accused approached the men later that night.

“It was very much a melee which started in the High Street and continued into two other streets.”

The Powers’ defence agent said the men were in a team of 10 contractors.

He added: “Both my clients accept their own conduct on the night was disgraceful.

“The contract was expected to end on the Friday and digs had been paid for on to the Saturday.

“A discussion had taken place in the club and an altercation continued on the street.”

The solicitor continued that John Power was a key worker and one of three men who organise staff when they are on contracts.

He said of Gary Power: “He’s currently on a rehabilitation programme through drink and drugs. There’s been a significant gap in his offending behaviour.”

Sheriff Gregor Murray fined each man £200.

John Power, 31, of Mossbank Avenue, Gary Power, 48, of Langdale Avenue, and Stephen Clark, 50, of Maryhill Road, all Glasgow, admitted breaching the peace on July 12 in High Street, Montrose, fighting with others and conducting themselves in a disorderly manner.
