The Corn Exchange in Arbroath is seeking to use a public footpath for an outdoor drinking area.
The JD Weatherspoon pub hopes to set up a portable banner barrier and place furniture in Market Place. The move will be discussed by councillors on Tuesday.
The proposed area lies at the foot of the steps leading to the pub’s main entrance, and would contain four tables, each with four chairs.
The thoroughfare contains several small businesses, including a photographer, a florist and a home furnisher.
There is residential accommodation on the two storeys above the caf directly opposite the proposed seating area.
There have been two letters of objections raising concerns about noise, anti-social behaviour and insufficient space.
However, the plans have been recommended for approval by the council’s head of planning and place, Vivien Smith, with the conditions there is no drinking at the outdoor area beyond 8pm and that no music be played in the area.
She said: “The development would not compromise road traffic or pedestrian safety and would not lead to an undue loss of amenity. The proposed use is also well regulated through the licensing and Roads Consent regimes.
“While two objections have been received, no issues are raised that would justify the refusal of the application.”
