A man caught driving in Angus while disqualified has been jailed for four months and banned for five years.
Stephen Makepeace was caught on the A90 less than two months after being given a suspended jail sentence in England for the same offence.
It was his third driving offence and Sheriff Gregor Murray jailed Makepeace despite a plea from his solicitor for a non-custodial sentence.
Appearing at Forfar Sheriff Court, Makepeace, 58, of Washington, Tyne and Wear, admitted driving on the A90 Dundee to Aberdeen road at Balnabriech at excess speed.
He further admitted driving while disqualified. Depute fiscal Hannah Kennedy said the incident took place around 5.30pm.
Police were undertaking routine speed checks when they became aware of a vehicle travelling at 98mph. They pulled the car over and found that Makepeace was a disqualified driver.
Defending, solicitor Bob Bruce said his client worked in the motor trade. He said Makepeace was being driven to Shetland to take a car to a client.
However, he said the driver wasn’t happy about driving up and getting on a ferry.
“He made the decision to drive and deliver it himself,” said Mr Bruce.
“It was a misguided decision. This is his third transgression and he finds himself in a difficult position.”
Mr Bruce said his client has tried to distance himself from driving since he was banned.
He also urged Sheriff Murray to impose a community payback order with unpaid work and a restriction of liberty order.
Mr Bruce said: “A restriction of liberty order for 12 months would be a deprivation of his freedom.”
Sheriff Murray said he had a duty to protect motorists on busy roads such as the A90 from disqualified drivers.
He told Makepeace: “This offence is your third transgression and occurred less than two months after you received a suspended prison sentence at Gateshead.
“The suspended sentence was a direct alternative to custody, In the circumstances, the only sensible, logical and appropriate sentence is prison.”
