A man who was involved in a street brawl in Arbroath has been jailed for 17 months at Forfar Sheriff Court.
Charles Gardiner, described as a prisoner at Perth, admitted repeatedly kicking his victim on the head and body to his injury on the Westport on December 2.
The 32-year-old also admitted behaving in a manner likely to cause fear or alarm by shouting and swearing at Connor McLeod.
Depute fiscal Joanne Smith told the court: “McLeod was on his way to the Premier Store in Arbroath and as he was making his way there he became aware of the accused near the Stag Bar.
“The accused and McLeod became involved in a verbal exchange.
“The complainer threw a punch at the accused and started to fight with him. The fight was broken up by Mr Scott, the manager of the Stag Bar, who knows both men.”
McLeod then went into the corner shop but the fight with Gardiner continued after he left the store.
“The complainer was knocked to the ground by an unknown male and while he was on the ground he was repeatedly kicked to the head and body by the accused,” added Ms Smith.
McLeod was later taken to Arbroath Infirmary where he received treatment on a cut below his right eye which was two inches long and an inch wide.
Footage of the attack was captured on CCTV and shown to Sheriff Pino Di Emidio.
Defence agent Billy Rennie said: “In terms of physical conduct between the two parties it’s McLeod who is the aggressor.”
Sheriff Pino Di Emidio told Gardiner that he took account of the fact that McLeod started the physical confrontation.
“However, you are a man who has a number of previous convictions for assault and in addition you have pled guilty to a charge of repeatedly kicking someone in the head and body.
“In the circumstances I require to deal with this matter with a custodial sentence.”
