Forfar man ‘beckoned’ boy into his home and held up sign asking child to expose himself

An Angus man who “beckoned” a young boy into his home has been placed on the sex offenders register.

James McDonald from Forfar “frightened” the boy and sent another running after holding up a sign asking to see his private parts.

The 32-year-old appeared at Forfar Sheriff Court and admitted two charges of indecent communication with a child and breaching the peace.

The court heard he blamed “urges” when asked for an explanation by police.

Depute fiscal Bill Kermode said: “At an unknown time between the 17th of August and 12th of December, the first complainer saw the accused knock on the window and gesticulate at him in a (sexual) manner.

“On the 24th of November, the same complainer again saw him motion with his fingers and beckon at him to come into the house.”

Mr Kermode said the 12-year-old was “frightened” by the episode.

The other complainer was 13 and again, on December 13, the accused held up a piece of paper at his window, requesting the boy show him his private parts.

He then opened the door and whispered to the boy to come in. The victim ran off “in a distressed state”.

McDonald initially denied the allegations but admitted the various parts of the charges.

“When asked why, he said he had urges to do this,” Mr Kermode said.

McDonald’s solicitor John Hall said there had been doubt over his client’s capacity to tender a plea but this had been confirmed by a psychologist’s report.

Previous convictions were admitted.

Sheriff Gregor Murray said: “In light of your previous convictions, and these charges, I will defer sentence on you for the preparation of criminal justice social work reports.”

McDonald was made subject to the notification requirements of the sex offenders register, the length of which will be determined at sentence on March 31.

McDonald, of Lily Wynd, admitted causing a breach of the peace between August 17 and December 14 at his home, standing at the window in his underwear, gesticulating in a sexual manner and motioning towards a boy to enter his home.

He further admitted sending a sexual written communication to a 13-year-old at his home on December 13, in that he held up a handwritten note asking to see his private parts.
