No action will be taken by prosecutors over the unexplained death of a Montrose man in August.
John Higgins was found in the communal close of his address in Christie’s Lane on Sunday August 9.
It was reported that Mr Higgins died after being taken home by police officers.
He was dropped off after being asked to leave a local nightclub and attempting to get back in.
It is understood the man was not escorted into the property.
Mr Higgins’ death was originally treated as unexplained.
The circumstances of the 42-year-old’s death were then the subject of a Police Investigations and Review Commissioner (Pirc) review as directed by the Crown Office and Procurator Fiscal Service.
It has now emerged that the fiscal’s service has confirmed that no prosecution is being contemplated at this time.
Mr Higgins, originally from England, had lived in Montrose most of his life.
A spokesman for Pirc said: “This investigation is now concluded and a report has been sent to the Crown Office and Procurator Fiscal Service.”
Mr Higgins had been out in Montrose socialising and watching football on a Saturday.
A local bar manager said he was a regular at Sharky’s Bar and Diner on George Street.
Carl Glanville said: “He had been out having a few drinks. He wasn’t any worse off than anyone else.
“He was a happy-go-lucky guy and was friends with everyone. He liked socialising and was very popular.
“We were told he had fallen and died all of his friends are devastated.”
