A City Quay resident could face further legal action from a property management firm after the company won approval to stay on at a recent owners meeting.
Ross and Liddell have been acting as factors collecting money from residents of phase two of Merchant’s Quay since 2008.
However the company had to call an emergency meeting of owners of almost 100 homes to re-establish their mandate after one resident disputed their right to be there.
Thomas Cargill challenged the firm on the grounds they had never shown him a contract and was taken to Glasgow Sheriff Court over the £698.76 in fees he had not paid for more than two years.
He represented himself at court and the action was abandoned by Ross and Liddell shortly before a second hearing.
His victory was short-lived after the company gained approval from the majority of home owners.
A spokesman said: “This represents an extremely positive result for all owners within the development and importantly, we also now have a clear mandate to pursue unpaid common costs, from defaulting owners, on behalf of proprietors.”
Mr Cargill has vowed to fight on but faces being taken back to court for the outstanding fees.
He said the outcome of the meeting has been ‘disappointing’ for him as he had hoped other residents would back him in opposing the company’s right to carry out maintenance works.
He said: “I’ll probably have to pay my bills from now on but as I still maintain they haven’t had a contract before now I won’t pay the outstanding fees.”
