Bett Homes have accused councillors of acting “unreasonably” by refusing planning permission for 25 houses.
The company wanted to add to their Sidlaw Fields development on the northern edge of the city, but members of the development management committee went against the recommendation of their own officers to turn down the application by 12 votes to 10.
The refusal was based on concerns about increased traffic congestion on Strathmartine Road, a lack of capacity at the local primary school and a lack of proof that building work would not worsen flooding problems in the area.
Bett have now asked the Scottish Government’s planning appeals unit to overturn the decision.
Their agents Houghton Planning said: “It is the appellant’s opinion that the council has acted unreasonably in refusing planning permission in this case.
“It is clear the council’s technical advisors and statutory consultees have remained silent, or have not objected, in relation to flooding, traffic and the capacity of the local school.
“It would thus appear to the appellant that their application has, therefore, been refused because of local opposition, rather than founded on supportable planning reasons.”
The council will have a chance to respond to the claims before a ruling is made on the appeal.
