Dundee court ruling could open floodgates to speeding appeals

Claims that thousands of motorists could have their speeding convictions quashed appear to have been backed up by a landmark ruling at a Dundee court.
In February, we told how a city solicitor was challenging speeding cases after he learned Transport Scotland had apparently forgotten to update road orders on a stretch of the A90 at Kingsway.
Now, in a new ruling, a Justice of the Peace has dismissed a speeding case against a Kingsway motorist as “not relevant” because the roads order was invalid.
The ruling, which the Crown Office is considering appealing, could now open the floodgates for drivers caught speeding on Kingsway and Arbroath Road in Dundee and on part of the Tay Road Bridge.
It is thought the loophole could affect over 20 years of convictions.
