A man who served the equivalent of a six-month jail term on remand for a bail breach against his ex-partner has been admonished.
Michael Kinmond appeared before Sheriff Pino Di Emidio at Forfar, where he admitted an indictment alleging the contravention of the bail order imposed at Arbroath Sheriff Court last April by contacting the woman.
Depute fiscal Joanne Smith told the court first offender Kinmond, 39, of Balmoral Place, Dundee, originally appeared from custody on May 15 last year in connection with the offence, in which the accused had phoned his ex-partner at home.
Defence solicitor Nick Whelan said his client had been in a relationship with the woman for around two years but they then separated and Kinmond was at that time living in East Port House bail hostel in Dundee.
“His position is that there was ongoing contact but he accepts that did not give him carte blanch to make contact.”
Sheriff Di Emidio noted that Kinmond had spent a total of 98 days in custody in relation to the offence, the equivalent of more than six months in jail.
“Notwithstanding the seriousness with which the court considers these matters, I consider it appropriate to deal with this by way of an admonition,” said the sheriff.
