Dundee building company WH Brown Construction, which went into receivership last August, has been ordered to pay five former employees the statutory 90 days’ payments in lieu of redundancy.
The five construction workers, who included former managing director John Lindsay, were successful in their claim to an employment tribunal in Dundee that they had been dismissed and the company had failed to comply with its obligations.
The tribunal, held in Dundee, has ruled in favour of the employees, Teresa Coull, Brook Street, Monifieth, David Wilson, Duncan Avenue, Arbroath, John Lindsay, Cupar Road, Newport, Robert Barty, Liff, by Dundee, and Keith Coull, Tommy Armour Place, Carnoustie.
The five were part of a workforce of 162 at the company when the receivers were called in on August 20, the tribunal ruled. Mr Lindsay gave evidence at the tribunal on behalf of all five employees and the panel accepted his evidence.
The tribunal found there had been no consultation with the workforce on the redundancies and there had been no attempt to elect employee representatives for those who were not members of a trade union.
The panel, chaired by Mr Ian McFatridge, unanimously granted the award to all five employees.
