Dundee councillors have given the green light to a £24 million supermarket development on the site of the former NCR Gourdie factory.
The plan for an Asda store with a cafe and filling station was unanimously granted full planning permission at Monday night’s meeting of Dundee City Council development management committee.
However, the development remains the subject of a legal challenge by supermarket rival Tesco.
The project was granted planning permission in principle last year but that decision has been challenged by Tesco, whose South Road store is a few hundred yards from the proposed Asda site at the junction of Kingsway West and Myrekirk Road.
The matter is now before the Supreme Court and a hearing has been set down for next March.
In his report to the committee, planning director Mike Galloway said the council’s legal adviser believed the local authority had a reasonable better than 50-50 chance of success in that case.
In the circumstances, he advised councillors not to give any weight to the previous granting of permission in principle when considering the full planning application.
The development will include a 570-space car park and landscaping. It will lead to significant changes in the road layout, with access to the supermarket off Myrekirk Road.
The Myrekirk roundabout on the Kingsway will be altered and traffic lights will be introduced, while the pedestrian underpass will be improved.
