Driver was three times drink limit with children in car

A drink-driver had children in his car when he was more than three times the legal limit.

A motorist became concerned about the erratic driving of a vehicle with two children in it and contacted the police, Dunfermline Sheriff Court heard.

When officers stopped Duncan Johnstone, described in court as an alcoholic, he was found to be more than three times over the legal limit.

Johnstone, 38, of Skua Drive, Dalgety Bay, admitted that on February 13 on the B9157 Aberdour to Dalgety Bay road he drove with excess alcohol of 73 microgrammes of alcohol in 100 millilitres of breath, the limit being 22 microgrammes.

He also admitted driving without a valid licence, without insurance, and with a tyre that had a portion of the ply or cord exposed.

Defence solicitor James Moncrieff said his client had been drinking the night before and “with hindsight he should have left more time between drinking and driving”.

He told the court his client did not feel under the influence at the time but added he was “essentially an alcoholic” who was used to functioning with drink in his system.

Sheriff Craig McSherry imposed a six-month restriction of liberty order, disqualified Johnstone from driving for four years and also fined him £420.
