A CROSSHILL man who got behind the wheel when he was more than five times the new drink drive limit was found sleeping in the back of his van.
Barry Burt, 51, of St Ronans Crescent, admitted at Dunfermline Sheriff Court that on December 30 he drove with 121 microgrammes of alcohol in 100 millilitres of breath, the legal limit being 22 microgrammes.
Sheriff Charles Macnair said he was “just persuaded” there was an alternative to custody, given Burt’s “previous good conduct”.
He imposed a community payback order with 300 hours of unpaid work and disqualified him from driving for 20 months.
Defence solicitor Gordon Martin said his client had been trying to get to sleep but could not because of noise from a party at his home and so had driven the van around 200 yards and climbed in the back.
