An Indian woman who married a man from Perth remains under investigation over allegations that the wedding was a sham.
In August last year, Hem Lata, 31, of Gowans Terrace, Perth, appeared at the city’s sheriff court to face criminal charges related to her marriage.
At that point she admitted that between December 23 2011 and March 23 2012 she sought to obtain permission to remain in the country by deception and entered into marriage with a man solely for the purpose of obtaining a visa.
Lata later changed her legal representation and has been attempting to have her guilty plea withdrawn.
She was due to appear at Perth Sheriff Court on Monday but the case was not called.
A spokesman for the Crown Office confirmed on Wednesday that the case remains active, however.
“The procurator fiscal at Perth received a report concerning Hem Lata and subsequently raised summary proceedings against her, charging her with seeking to stay in the UK by deception, contrary to Section 24A(1)(A) of the Immigration Act 1971,” he said.
“It is the duty of the Crown to keep cases under review and, after full and careful consideration of the facts and circumstances of the case, including the available admissible evidence, it was decided that the case against her should not be called on Monday.
“The case remains under active consideration,” added the spokesman.
