A motorist was branded “arrogant” by a sheriff as he was sentenced for two drink-driving offences.
Malcolm Kerr was caught twice in the space of a week, and on the second occasion was more than 2 times the legal limit.
Depute-fiscal Stuart Richardson told Perth Sheriff Court that on the first occasion Kerr was caught at 8.10pm and on the second at 3.20pm.
Solicitor Steve Lafferty, defending, said the 68-year-old had turned teetotal since the incident.
He added that Kerr had suffered a subdural haematoma in an earlier incident, which may have affected him on the second occasion.
Mr Lafferty said Kerr lived seven miles from Dunkeld and was driving on country roads.
However, Sheriff Foulis said that the second occasion was significant as the town was likely to have been busy on a summer afternoon.
He told Kerr: “The attitude reflected in the report is not favourable as far as you’re concerned.
“There’s almost a suggestion that you wonder what all the fuss is about.
“It might reflect a degree of arrogance on your part.”
Kerr was previously found guilty of driving on the A984 Caputh to Dunkeld road on July 6 with 88mg of alcohol in 100ml of blood; and on the A822 Amulree to Dunkeld road on July 12 with 138mg of alcohol in 100ml of blood.
The legal limit is 50.
Sheriff Foulis fined Kerr, of Easter Ballachraggan Farm, Dunkeld, £5,000 and banned him from the roads for five years, after which he must sit the extended driving test in order to regain his licence.
