A sheriff has warned a Perthshire man that he was on his “last chance”, following a drunken assault.
Terry Hayburn appeared in the dock at Perth Sheriff Court after admitting assaulting another man on May 26 last year at the Niblick bar in Auchterarder, by punching him on the face and causing him to fall to the ground.
Sheriff Michael Fletcher placed the 44-year-old, of Ruthven Park, Auchterarder, on a restriction of liberty order for six months, effectively keeping him housebound between 7pm and 6am.
He told Hayburn: “Your record is not a very good one as far as assault is concerned.
“I noticed in the report there is a lot said about the fact you were provoked and that is something you say each time. I think you will have to think very carefully about this provocation you think occurs.
“It seems to me that while you think you were being provoked, the rest of us might cope and I don’t think provocation will help you in the future.”
Sheriff Fletcher also advised Hayburn that he was being placed on a restriction of liberty order as a direct alternative to custody.
“It’s a bad assault, as the photographs make clear,” he said.
“This is your last chance before a straightforward custodial sentence.”
