A Perth woman who had sex with a man in a public park in full view of people has been described as being ”deluded” about her drinking.
Grant Bruce, solicitor for Ann-Marie Townsley (42), of St Catherine’s Road, Perth, told Perth Sheriff Court on Tuesday that his client feels she now has her alcohol problem under control.
However, the court had previously heard how she and partner Fred Mills (50) had committed an act of public indecency by having sex on a bench in the South Inch, Perth, in full view of joggers, dog walkers and mothers taking their children home from school.
The couple only stopped when a dog walker objected to their behaviour, leading to Mills shouting at him.
In March, Mills was sentenced to six months in prison and put on the sex offenders register for seven years.
On Tuesday, Sheriff Robert McCreadie fined Townsley £450 and put her on the sex offenders register for five years.
The court had previously heard how the sex offence was committed in a park near Perth city centre.
Depute fiscal Carol Whyte said the park is ”popular with dog walkers, joggers and people taking their young children to the adjacent play park.
”The locus was busy with people and the incident was in full view of any people nearby at the time,” she told the court.
”At around 4pm a member of the public was walking his dog and stopped to sit on a bench in the park. The man became aware that both accused were sitting close to him and he saw Mills’ trousers were at his ankles and he saw Townsley climb on top of Mills with her trousers down.
”They then engaged in sexual intercourse. The pair were also seen by another member of the public who was walking with her baby.”
The court had heard the man on the bench asked the pair to stop but Mills called him a ”pervert” and made other comments to him in an aggressive and threatening manner.
Mills and Townsley had been in a relationship for four years and the pair had kissed in the dock prior to Mills being sent to prison.
Mr Bruce, defending, said his client feels she has her alcohol consumption under control, but admitted she didn’t recall the incident at the park due to being drunk.
However, Sheriff McCreadie told Townsley: ”You are deluded if you think you have this under control.”
Mills had also admitted a breach of the peace on the same day and location by making derogatory comments towards a man.
