M90 lorry driver was four times legal drink limit

A lorry driver has appeared in court after being caught driving on the M90 while more than four times the legal alcohol limit.

Sheriff Lindsay Foulis told Colin Smith (42), of Millhall Court, Airdrie, that if he were to drive before his next appearance at Perth Sheriff Court ”it is fair to say” he could face a custodial sentence.

Appearing in court on Wednesday, Smith admitted that, on Tuesday on the M90 Inverkeithing to Perth motorway at Junction 9, he drove his 44-tonne articulated vehicle with excess alcohol 146 mic and while on bail. The legal limit is 35 mic.

Addressing Smith, Sheriff Foulis told him: ”It would be fair to say that, with regard to the level of reading here, if you were to drive in the meantime and appear again in court, the likelihood is that you will lose your liberty.”

Tayside Police’s road policing unit thanked a motorist who contacted officers after noticing Smith’s ”erratic driving.”

”Many thanks to the motorist who phoned in reporting his erratic driving,” said a spokesman. “They may have prevented a serious accident.”

Sentence was deferred until November 14 for background reports, production of Smith’s driving licence and a DVLA printout.

Smith, who appeared from custody, was given an interim driving ban.
